I. PRODUCTS AND SERVICES:

Latour-Marliac SARL, located in Temple-sur-Lot 47110 RCS: 499 473 601, proposes the sale of products and services from a catalog available on the Internet.

Plant orders are treated from end of march until end of october / all year long for accessories and giftshop (depending of availabilities)

II. ORDERS:

The customer selects using the electronic catalog products and services it wishes to acquire and transmits its order to SARL Latour-Marliac from an order form available on the site to be validated following the instructions.

III. SHIPPING CONDITIONS 

Plant orders are shipped beginning April 1 in the order received, except for orders containing tropical water lilies and other sensitive plants, such as water lettuce. Accessory and souvenir orders are shipped year-round subject to availability.

When orders contain both types of plants, they are shipped in two stages. In this case, Latour Marliac will pay for the delivery costs if the total amount of plants ordered for each type is greater than 25 euros including tax. Otherwise, the entire order will be shipped at the most convenient time for the sensitive plants..

IV. SELLING PRICE :

The selling prices are net prices and are only valid for the website. Participation in delivery costs, if requested, is mentioned on the bill of final validation. The additional shipping costs may be requested by email for some command category "sheets" and for orders exceeding 30kg.

Pricing error.

Article L. 121-18 of the Consumer Code requires the French traders, as part of an Internet purchase, clearly indicated before ordering the price you must pay, including all taxes. In addition, it will also specify clearly and unambiguously displayed if the cost includes postage and delivery or, failing that, specify.

If ridiculous price given the value of the property, the trader can request cancellation of the order.
Secondly, and consistently, case law refuses to cancel the sale for mere error in the value of a product. Courts treat indeed restrictively, that such nullity shall not be accepted if the error display shows a ridiculous price as the consumer can claim to have taken the award for the actual value of the property.

V. NON-AVAILABILITY:

SARL Latour-Marliac will strive to meet the demands of the customer and to execute orders of the latter products and services.

VI. RETURNS:

We are committed to provide you complete satisfaction for all of our products and services. According to the legislation governing the mail order in force for selling online, you can return any item within 30 days of the delivery date being reimbursed the full price of the item concerned (delivery charges are not refunded). However the articles not corresponding to your waiting must be returned in new condition in their original packaging. In accordance with Articles L.120-20 and following the Consumer Code, you have a period of seven (7) days to exercise your right of withdrawal without any reasons or pay penalties except, where applicable, the cost of return. The seven-day period runs from the date of receipt of the items.

Returns of aquatic plants, which are perishable, must be made within 24 hours of receipt.

VII. ACTS OF GOD:

The responsibility of the LLC Latour-Marliac not be engaged in case of force majeure such as strikes, fires, natural disasters or other, this list is not exhaustive.

VIII. PAYMENT :

Payment products and services can be made by security, àl'ordre bank check SARL Latour-Marliac, subject to all necessary checks. Effective Jusqu'àréception of all amounts owed to it in full, SARL Latour-Marliac remains owner of the delivered products and reserves the right to recovery by all means at its disposal in the event of failure final settlement.

IX. DATA PROTECTION:

The customer has a right to access, modify and delete data concerning them (art.34 of the law "and Freedoms"). To do so, please contact SARL Latour-Marliac, Le Bourg, 47110 Le Temple-sur-Lot. The only information collected in the form of cookie relates to the references of the ordered products and services and a randomly generated ID number.

X. DISPUTES:

In case of dispute, the parties grant jurisdiction to the Commercial Court 47300 Villeneuve-sur-Lot.
